J&J Misled Pennsylvania on Drug’s Risks, Lawyer Says (Update2)

June 3 (Bloomberg) -- A Johnson & Johnson unit misled Pennsylvania officials about the health risks of its Risperdal anti-psychotic drug and duped the state into paying $289 million more than it should have for the medicine, a lawyer said.

"Pennsylvania officials wouldn’t have paid a premium for Risperdal had they known it was no more effective than existing anti-psychotic drugs and was found to cause diabetes, Fletch Trammell, a lawyer for the state, told a Philadelphia jury today. Pennsylvania is seeking to recover $289 million it paid for Risperdal prescriptions.

“There were a dozen anti-psychotics that were just as good as Risperdal and cost a fraction” as much, Trammell said in opening statements in the trial of the state’s rebate lawsuit against J&J.

Risperdal generated $3.4 billion in sales in 2008, or 5.4 percent of sales for New Brunswick, New Jersey-based J&J. The drug, made by its Janssen Pharmaceutica unit, was one of J&J’s biggest sellers before patent protection expired.

J&J’s lawyer contended in his opening statement that the drugmaker did nothing wrong in marketing Risperdal to state- sponsored health-care programs.

“There is no merit in the case that” the state will present, Thomas Campion, J&J’s lawyer, told jurors today.

Off-Label Marketing

J&J faces hundreds of lawsuits by former Risperdal users alleging the company minimized the diabetes risk posed by the anti-psychotic medicine and overstated its benefits. Consumers contend the drugmaker boosted sales by marketing the drug for unapproved uses, such as treating dementia patients.

The Justice Department is investigating such practices within Janssen and other drugmakers. Nine states including Louisiana have sued J&J, claiming it violated a federal bar to off-label marketing, according to company regulatory filings.

Under U.S. law, a doctor can prescribe a medicine for any condition, as long as the U.S. Food and Drug Administration found it safe and effective for at least one ailment."

Why do I question, think and ask?

1999 a doctor gave my daughter RISPERDAL at age 11 after quickly and efficiently! (mis)diagnosing her as Childhood Bipolar due to a psychotic reaction to Imipramine, an antidepressant prescribed for bed wetting prevention. At the time, I had no idea what the drug was, it was described to me as something to stop "spastic bladders".

TODAY, 2010 my daughter is in a rehabilitative care facility due to the harm and brain damage done via the psych meds which were at times over-dosed in hospitals.

Swept up, in the Biederman paradigm, the last decade has been a constant battle from me, a mom, to show the doctors what was not right in her world.

IN fact, she was a product of the side effects of these medications.

Slowly being brought down from drugs, her real self is beginning to show again, at age 22.

When they gave her the Risperdal in the psych ward at age 11 she was pale and I had no idea what was happening, in fact I thought she was dead when I saw her.

In 1999, I did not have any information that we have now.

Nor, did I ever expect to embark on this research journey, only to find corruption, marketing tactics and sales, skewed data, and researchers such as Biederman pocketing millions of dollars and not disclosing the income.

Seated Senator Charles Grassley's queries were the tip of the iceberg.

When Biederman gave the depo for this case, he said unbelievable things that are documented now. Identifying with "GOD".

AS a solid base of complete control, psychiatrists (NOT ALL) have over people, in this pharma-funded medication based paradigm of treatment.

Take the time to stop and read the deposition pdf and any other article linked here and in those articles....then stop and ask yourself:

Why? at what cost? 26 million dollars were spent from PhRMA lobbying the U.S. government....do you want to know why? not for your health. For profit.

"Unfortunately," you are not alone. Anybody who questions what is going on is patronized in such a way as to make it clear that we're the ones who are delusional. I got very tired of having to do my own research. I felt that the doctors should be on my wavelength. But, they were not, and I guess that's a lesson everyone has to learn, whether it's mental illness or any other kind. When it comes to our own health or that of our relatives, we are the best investigators.

Another thought from reading the stuff about Respirdal is: You would think the State of Pennsylvania would be only too aware that pharmaceutical companies want to sell their latest products at higher prices. Since so much money is at stake, wouldn't their normal practice be to do their homework? What piece of the puzzle am I missing here?

The doctors are on no one's wavelength other than Big Pharma. Pharmaceutical companies are lining their pockets AND easing the burden of care. Drug the shit out of the patients and get them off the docs' backs seems to be their motto. Mental illness is hard to diagnose and too often they rely on drugs first, diagnosis is then guessed at by how the patient reacts to the drugs.
The unfortunate thing is that too often the patient is on a "therapeutic dose" and when they want to get off the drug, it is difficult. My daughter's worst psychotic episodes have been from forced withdrawal from antipsychotics and anti-anxiety meds. The Menninger Hospital stripped her of drugs her body had come to rely on and for seven weeks my daughter was in severe withdrawal. They managed it by dousing her with OTHER drugs to counteract the escalating symptoms.
Where does the overhaul of this system begin? Our daughter are victims of a broken, complex network. It is impossible to be a big enough voice. I thank you for your post. They are always informative and eye opening.
